Trial Law

The lawyers for a former apartment security guard on trial accused of murder rested their case Monday without calling a single witness.

Prosecutors wrapped up their case against Stephen Duxbury on Monday afternoon. Duxbury decided not to testify in his defense, and his lawyers did not put on a case.

Duxbury, 35, is charged with first-degree murder in the 2015 death of Sasha Samsudean, 27. Samsudean lived at the Uptown Place apartments north of downtown Orlando, where Duxbury was a security guard.

The trial entered its second week Monday. Jurors heard from a Florida Department of Law Enforcement DNA expert, who said Duxbury’s DNA was found on swabs taken from Samsudean’s chest.

An Orlando Police Department homicide detective told jurors about his conversation with Duxbury the night Samsudean was found dead in her bed. Duxbury said he saw her coming home from a night out in October 2015 and tried to help her get into her apartment when she could not remember the code to her keypad lock.

“She was stumbling around, crashing into the walls. Her footfalls were just ‘slap, slap, slap, slap,’” Duxbury told Detective Toyd Montford in the early-morning hours after Samsudean’s body was found.

Duxbury also told Montford he is not allowed to go into apartments.
